"The last will and testament of Samuel Garber of Washington Township, Richland County, Ohio.- In the name of the Benevolent Father of All- I, the said Samuel Garber being of sound and dep osing mind and memory- considering the uncertainty of the continuance in life- and desiring t o make such disposition of my worldy state as I deem best, do make and publish and declare th is to be my last will and testament hereby revoking and annulling any and all former wills wh atsoever by me made. First:-I desire all my debts and funeral expenses be paid as soon as possible after my deceas e. Second:-I will and bequeath to my beloved wife Barbara Garber the one third of all that may b e raised on my farm from year to year during her natural life, also the use of the homestea d on which we reside during her natural life, together with such other articles of househol d and kitchen furniture as she may select, witto? ove?---Support, all in lieu of her dower in terest in my estate. Third:-That all my real estate at the death of my wife I desire that it shall be appraised an d divided between four of my children or their heirs, should any of them die before distribut ion thereof be made. to wit: I give and devise to my daughter Susann(h) Arnold. Seventeen acr es of land out of the South East corner of the west part of the west half of fractional Secti on five in Pike Township Knox County, Ohio. Also, I give and devise to my son John Garber th e balance of said piece of land in fractional Section five in Pike Township Knox County, cont aining about forty acres, after the Share of my said Daughter is surveyed off.- I also give a nd devise to my Daughter Catherine Gable fifteen acres of land out of the North West corner o f (th)e part of the South East quarter of Section Thirty one, Range Seventeen Township Libert y, -ue, this fifteen acres to be take out of said corner adjoining the land now owned by Dani el Gable. -Also I give and devise the residue of my real estate to Sarah Ann Stofer my Daught er known as part of the old homestead and a piece of land I purchased of David Taylor adjoini ng the same containing in all about fifty acres - I also give and devise to my Daughters Mar y Bemiller and Rebecca Bemiller, each eight hundred and twenty five dollars, there to be dedu cted from Rebeccas Share, Two Hundred Dollars that I have already paid her. My will is that m y son John Garber give his Eight promissory notes to Mary Bemiller for said sum of Eight-twen ty five dollars in equal amount money after my death and the death of my wife without interes t to be paid as follows: One, Two, Three, Four, Five, Six, Seven and Eight years after date . My will is that Sarah Ann Stofer after my death & the death of my wife give her Six promiss ory notes to Rebeccas Bemiller of equal amount so as to be paid as follows: One, Two, Three , Four, Five and Six years- Sarah Ann Stofer to pay all Doctor Bills of me or my wife funera l expenses and Tombstones for me and my--out of her share in addition to what she is to pay R ebecca Bemiller, also the claim she holds against me--That she also cancel the same--My wil l is that all my just debts be paid out of the personal Estate if there is enough of the sam e to pay the same further than those above provided for. I do also hereby constitute and appo int Daniel Beal my Executor of this my last will and testament, and I do hereby give him ful l power and authority to make and execute and deliver proper deeds of conveyances to the pers ons mentioned in this will for the lands so willed to them and all deeds so made as fully an d ---ply as I could were the same executed by me while in full life and futher that my said E xecutor have full power to sell at private sale or otherwise any of my personal Estate to ena ble to pay all just debts as soon as possible. I desire that the Probate Court omit the appra isment of any and all of my personal estate. On Witness whereof I have hereunto set my hand and seal this 21st day of November, AD 1882.
